Scope of Service

Aid-ER provides AI-powered medical triage services designed to:

  • Help assess the urgency of your symptoms
  • Provide guidance on appropriate care settings (emergency, urgent care, primary care, etc.)
  • Offer general health information and educational resources
  • Connect you with healthcare providers when appropriate

Our service does NOT provide medical diagnoses, prescribe medications, or offer specific treatment recommendations.

User Eligibility & Requirements

To use Aid-ER, you must:

  • Be at least 18 years old or have parental/guardian consent
  • Provide accurate and truthful information about your symptoms and medical history
  • Have the legal capacity to enter into this agreement
  • Use the service for legitimate health assessment purposes only

Parents or guardians may use the service on behalf of minors under their care, taking full responsibility for the accuracy of information provided and decisions made based on our guidance.

AI Technology & Limitations

Aid-ER uses advanced artificial intelligence and machine learning algorithms to analyze symptoms and provide triage guidance. However, you acknowledge that:

  • AI technology has inherent limitations and may not capture all medical nuances
  • Our algorithms are continuously learning and improving but are not infallible
  • The accuracy of our guidance depends on the accuracy of information you provide
  • Rare conditions or complex cases may not be properly assessed by our AI
  • Technology failures or service interruptions may occur

User Responsibilities

When using Aid-ER, you agree to:

  • Provide accurate, complete, and truthful information about your symptoms and medical history
  • Use your own judgment in combination with our guidance when making health decisions
  • Consult healthcare professionals for proper medical diagnosis and treatment
  • Keep your account information secure and confidential

Prohibited Uses

You may not use Aid-ER to:

  • Use the service for illegal activities or to harm others

Service Availability

  • Force majeure events beyond our control

Intellectual Property

All content, technology, software, and materials provided by Aid-ER, including but not limited to our AI algorithms, user interface, text, graphics, and trademarks, are owned by Aid-ER or our licensors and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use our service for personal, non-commercial health assessment purposes only.

Privacy & Data Use

Your privacy is important to us. Our collection, use, and protection of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Aid-ER, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AID-ER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO MEDICAL COMPLICATIONS, DELAYED TREATMENT, OR HEALTH-RELATED DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

Our total liability to you for any claims arising from your use of Aid-ER shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Aid-ER, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of our services, violation of these Terms, or infringement of any rights of another party.

Termination

Either party may terminate your access to Aid-ER at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use our service ceases immediately.

Sections of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) shall remain in effect after termination.

Governing Law & Dispute Resolution

These Terms are governed by the laws of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Aid-ER shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to participate in class action lawsuits or class-wide arbitrations against Aid-ER.

Changes to Terms

We may modify these Terms at any time by posting updated terms on our website. Material changes will be communicated via email or prominent notice on our platform. Your continued use of Aid-ER after such changes constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using our service.
